General Terms and Conditions (GTC)

1. Scope of Application

1.1 These General Terms and Conditions apply to all orders placed by consumers or businesses (hereinafter “Customer”) via the online shop solarpunknow.world of
Ehrlich & Friedrich GbR, Scharnweberstraße 49, 10247 Berlin, Germany (hereinafter “SolarPunk Now” or “we”).
1.2 We only recognise deviating terms and conditions of the Customer if we have expressly agreed to their validity in writing.

3. Offer and Conclusion of Contract

3.1 The presentation of the products in the online shop constitutes a binding offer to conclude a contract.
3.2 The contract is concluded when the Customer clicks “Buy now” at checkout (which constitutes acceptance of the offer).
3.3 After submitting the order, the Customer receives an automatic order confirmation by e-mail.

4. Prices and Shipping Costs

4.1 All prices are stated in euros and include statutory value added tax.
4.2 Shipping costs are added and are clearly indicated at checkout.
4.3 For deliveries outside the EU, customs duties and taxes may apply, which are borne by the Customer.

5. Payment Terms

The following payment methods are available:
– Credit card (Visa, Mastercard, AmEx)
– PayPal
– Klarna SOFORT / invoice (depending on availability)
– Apple Pay / Google Pay
Payment is charged immediately upon conclusion of the contract.

6. Delivery Terms

6.1 We deliver within Europe (EU as well as Switzerland, the United Kingdom and Norway) exclusively by DHL Paket with tracking.
6.2 Delivery times are stated on the shipping page; they begin upon receipt of payment.
6.3 If an item is unavailable, we will inform the Customer immediately; any payments already made will be refunded.

7. Retention of Title

The goods remain our property until payment has been made in full.

8. Right of Withdrawal

Consumers have a statutory right of withdrawal in accordance with our Instructions on Withdrawal. Businesses are not granted any voluntary right of withdrawal.

9. Transport Damage

If goods are delivered with obvious damage, the Customer is asked to report such defects to the delivery agent immediately if possible and to contact us without delay.

10. Warranty and Guarantees

10.1 The statutory law on liability for defects applies.
10.2 Guarantees only exist if they have been expressly stated in the product description.

11. Liability

11.1 We are liable without limitation for intent and gross negligence.
11.2 In cases of slight negligence, we are only liable for damages arising from injury to life, body or health or from the breach of essential contractual obligations (cardinal obligations), limited, however, to the foreseeable damage typical for this type of contract.
11.3 Any further liability is excluded.

12. Dispute Resolution

12.1 The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/.
12.2 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final Provisions

13.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
13.2 If the Customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin.
13.3 Should individual provisions of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid.
